8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE UNITED STATES LAW, INCLUDING THE FEDERAL TRADE COMMISSION ACT AND OTHER APPLICABLE CONSUMER PROTECTION STATUTES, PIZZA LUCE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR:

- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES;
- DAMAGES ARISING FROM YOUR INABILITY TO ACCESS OR USE THE SERVICES;
- DAMAGES ARISING FROM ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR PERSONAL INFORMATION;
- DAMAGES ARISING FROM ERRORS, INTERRUPTIONS, VIRUSES, OR OTHER HARMFUL ELEMENTS IN THE SERVICES;
- DAMAGES ARISING FROM THIRD-PARTY ACTIONS OR CONTENT.
IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF PIZZA LUCE TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA LUCE IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
The limitations of liability set forth above are fundamental elements of the basis of the bargain between Pizza Luce and you. Some states do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you in their entirety.
9. Indemnification
You agree to defend, indemnify, and hold harmless Pizza Luce and its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, contractors, licensors, service providers, subcontractors, suppliers, and successors (collectively, "Indemnified Parties") from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

- Your violation of any applicable federal, state, or local law or regulation;

11. Dispute Resolution
11.1 Informal Resolution

11.2 Binding Arbitration

YOU AND PIZZA LUCE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and Pizza Luce agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
11.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidentiality obligations. Nothing in this section shall limit either party's right to seek such relief.
12. Term and Termination
